These Terms of Service ("Terms", "Terms of Service") govern your access to and use of the Avenue Closet website and your purchase of products through our online store.

These Terms are subject to the applicable laws and regulations of the Democratic Socialist Republic of Sri Lanka, including mandatory consumer protection rights.

 

Eligibility and Use of the Website

Avenue Closet does not impose a minimum age requirement for placing an order through the website.

Customers may purchase products for themselves or for another person, provided that all information supplied during the ordering and delivery process is accurate and lawful.

You agree to use the website only for lawful purposes and in accordance with these Terms.

Avenue Closet makes reasonable efforts to ensure that product descriptions, photographs, measurements, colors, specifications, and other product information displayed on the website are accurate and useful to customers.

However, certain differences may occur between the product displayed on your screen and the actual product, particularly with respect to,

  • Brightness;

  • Texture;

  • Appearance; and

  • Other visual characteristics.

Such differences may result from your device, display settings, lighting, photography, or other technical factors.

Product descriptions, specifications, photographs, availability, and other information may be updated or changed from time to time.

Avenue Closet may discontinue products or modify product offerings at its discretion, subject to applicable law and any orders already accepted.

 

Product Availability

Products displayed on the Avenue Closet website are subject to availability.

Although we make reasonable efforts to maintain accurate stock information, there may occasionally be circumstances where a product shown as available cannot be fulfilled.

If a product becomes unavailable after an order has been placed, Avenue Closet may contact the customer and provide an appropriate resolution, which may include,

  • Offering an alternative product;

  • Removing the unavailable product from the order;

  • Providing a refund for the unavailable product; or

  • Cancelling the affected order.

Where appropriate, any refund will be processed in accordance with our Refund, Return and Exchange Policy and applicable law.

 

Placing an Order

When you place an order through the Avenue Closet website, you are submitting a request to purchase the products selected by you.

Before confirming an order, customers should carefully review,

If Avenue Closet cancels an order for which payment has already been received, the applicable amount will be refunded or otherwise dealt with in accordance with applicable law and our relevant policies.

Where reasonably possible, Avenue Closet will contact the customer using the contact information provided during checkout.

 

Pricing

All product prices displayed on the Avenue Closet website are stated in the currency shown at the time of purchase.

Prices, discounts, promotions, and other offers may change from time to time.

Avenue Closet will generally charge the applicable price displayed for the product at the time the order is placed, subject to applicable law.

If an obvious pricing error occurs on the website, Avenue Closet reserves the right to correct the error and, where appropriate, cancel an affected order.

If payment has already been made for an order cancelled because of an obvious pricing error, Avenue Closet will arrange an appropriate refund of the amount paid for the affected order or product.

Delivery charges and other applicable charges will be displayed during the checkout process where applicable.

Avenue Closet will not intentionally use a disclaimer to misrepresent the actual price payable for a product.

 

Promotions and Discounts

Where Avenue Closet reasonably believes that a promotional code has been misused or obtained through fraudulent or unauthorized means, the company may cancel the relevant transaction or promotional benefit.

 

Payment

Avenue Closet will make available one or more payment methods through the website.

The payment methods available to a customer may vary from time to time.

By submitting an order using a payment method, you confirm that,

  • The payment information provided by you is accurate and complete;

  • You are authorized to use the selected payment method;

  • You authorize the applicable payment provider to process the payment; and

Avenue Closet does not control the internal systems of third-party payment providers and is not responsible for technical failures or delays caused solely by those providers.

Cash on Delivery

Where Cash on Delivery ("COD") is made available as a payment option, the customer agrees to pay the applicable order amount to the delivery service provider at the time of delivery.

Avenue Closet may impose reasonable conditions or restrictions on COD orders, including restrictions based on delivery location, order value, previous order history, or suspected misuse of the COD service.

Avenue Closet reserves the right to decline or restrict COD orders where reasonably necessary to prevent fraud, repeated non-collection, or abuse of the service.

 

Delivery

Avenue Closet currently provides delivery services within Sri Lanka only.

Delivery charges and available delivery options will be communicated or displayed to the customer during the ordering process, where applicable.

Customers are responsible for providing an accurate and complete delivery address and contact information.

Avenue Closet will make reasonable efforts to dispatch and deliver accepted orders within the applicable estimated delivery period.

Delivery times may vary depending on,

  • Delivery location;

  • Courier or logistics provider;

  • Weather conditions;

  • Public holidays;

  • Transportation conditions;

  • Operational circumstances; and

  • Other circumstances beyond Avenue Closet's reasonable control.

If a delivery cannot be completed because the customer provided an incorrect or incomplete address, failed to respond to delivery attempts, or otherwise prevented delivery, additional delivery arrangements or charges may apply.

Avenue Closet may use third-party courier and logistics providers to fulfil deliveries.

 

Order Cancellation

Customers should carefully review their orders before confirming them.

Avenue Closet may be unable to accommodate cancellation requests after an order has been accepted, processed, packed, or dispatched.

Where cancellation is requested and can reasonably be accommodated, Avenue Closet will assess the request in accordance with its operational circumstances and applicable law.

Nothing in this section limits any mandatory cancellation, withdrawal, or other consumer rights applicable under Sri Lankan law.

 

Returns, Exchanges and Refunds

Returns, exchanges, and refunds are governed by the Avenue Closet Refund, Return and Exchange Policy, which forms part of these Terms of Service.

The Refund, Return and Exchange Policy sets out the applicable conditions and procedures relating to,

  • Non-returnable products;

  • Return shipping costs;

  • Promotional codes issued in place of refunds; and

All rights not expressly granted to you are reserved by Avenue Closet and the applicable rights holders.

However, purchases made through the Avenue Closet website are transactions between the customer and Avenue Closet (Pvt) Ltd.

Shopify is not the seller of Avenue Closet products and is not responsible for the fulfilment, quality, returns, exchanges, refunds, or other aspects of transactions between Avenue Closet and its customers, except to the extent required under applicable law or Shopify's own contractual obligations.

  • Decline or cancel an order;

  • Restrict payment methods;

  • Restrict promotional benefits;

  • Suspend or terminate an account; or

  • Take other reasonable measures necessary to protect the business and its customers.

Where an order is cancelled after payment has been received, any applicable refund will be handled in accordance with applicable law.

 

Disclaimer of Warranties

To the maximum extent permitted by applicable law, Avenue Closet does not guarantee that all information displayed through the Services will always be completely accurate, current, or free from typographical or technical errors.

Indemnification

These Terms of Service and any dispute arising from or relating to the Services or purchases made through the Avenue Closet website shall be governed by and interpreted in accordance with the laws of the Democratic Socialist Republic of Sri Lanka.

Subject to applicable law, the courts of Sri Lanka shall have jurisdiction over disputes arising from these Terms or transactions with Avenue Closet.

Nothing in this section prevents a consumer from exercising any mandatory right to seek redress or use any dispute-resolution mechanism available under applicable Sri Lankan law.

This informal complaint process does not prevent a customer from exercising any statutory right or legal remedy available under Sri Lankan law.

 

Severability

If any provision of these Terms is found to be unlawful, invalid, or unenforceable by a competent authority or court, that provision shall be interpreted or modified to the minimum extent necessary to make it enforceable, where legally possible.

If it cannot be made enforceable, the affected provision shall be severed to the extent necessary, without affecting the validity and enforceability of the remaining provisions.

 

No Waiver

If Avenue Closet does not immediately enforce a provision of these Terms, this does not mean that Avenue Closet has waived its right to enforce that provision in the future.

Any waiver must be expressly made by Avenue Closet to be effective.

 

Entire Agreement

These Terms of Service, together with the policies and documents expressly incorporated into them, constitute the terms governing your use of the Avenue Closet Services and your purchases through the website.

These documents include, where applicable,

  • The Refund, Return and Exchange Policy;

  • Specific promotional terms;
